These Terms and Conditions (the “Terms”) apply to the sale of original paintings, sculptures, photography, and limited-edition prints (the “Artworks”) by Giacomo Giannelli (the “Artist”, “we”, “us”).
By purchasing from our website giacomogiannelli.com, exhibitions, pop-up galleries, or art fairs, you (“the Buyer”, “you”) agree to these Terms.
1. Contract
These Terms form the entire agreement between you and Giacomo Giannelli. They apply to online sales, in-person purchases, and commissioned works.
2. Statements About Artworks
- All descriptions, attributions, dates, provenance, or condition reports represent our opinion only and are not guaranteed.
- Images, advertising, and promotional material are for presentation purposes only and may not be exact reproductions.
- You are responsible for satisfying yourself as to the condition and details of the Artwork before purchase.
3. Payment
- The Artwork price, plus delivery and any additional agreed costs (e.g., framing), must be paid in full before delivery.
- Payments are only complete once cleared funds are received.
- We may request proof of identity for security purposes.
- Ownership of the Artwork passes only once payment has been received in full.
4. Delivery, Shipping & Risk
- Delivery is arranged only after payment is complete.
- Delivery costs are your responsibility unless otherwise agreed in writing.
- Risk transfers to you once the Artwork is delivered to the agreed address or collected in person.
- If you arrange your own courier, risk passes to you upon collection.
- Delivery dates are approximate and not guaranteed. We are not liable for delays outside our control.
5. Insurance
- Standard shipments are sent at the buyer’s risk.
- Insurance is optional and available upon request at the buyer’s expense.
- If you decline insurance, you accept all responsibility for any loss or damage in transit.
- Once the Artwork is delivered or collected, you are solely responsible for its safety and insurance.
6. Export & Taxes
- You are responsible for all import duties, taxes, or fees in your country.
- If UK authorities or other tax bodies claim costs (e.g., VAT, customs fees) from us due to your purchase, you agree to reimburse us.
- We are not responsible if you fail to obtain any required import or export licenses.
7. Returns & Refunds
- Online purchases may be cancelled within 14 days of delivery by written notice.
- The Artwork must be returned within 21 days, in its original condition and packaging.
- You are responsible for all return costs, including packaging, shipping, and insurance.
- Refunds are only processed after the Artwork is inspected and confirmed undamaged.
- Refunds are issued using the original payment method within 14 days of safe return.
- Deductions may be made if the Artwork is returned damaged or handled negligently.
8. Limitation of Liability
- We are not liable for installation, hanging, or care of the Artwork once delivered.
- We exclude all liability for indirect, incidental, or consequential damages (e.g., loss of profit).
- Our maximum liability is limited to the price you paid for the Artwork.
9. Data Protection
We collect and use personal data in accordance with our Privacy Policy. By purchasing, you consent to this use.
10. Copyright & Intellectual Property
- Purchasing an Artwork does not transfer copyright or reproduction rights.
- All images, materials, and promotional content remain the property of Giacomo Giannelli.
- Any reproduction, distribution, or commercial use of Artwork images requires written permission.
11. Governing Law
These Terms are governed by the laws of England & Wales. Disputes will be subject to the exclusive jurisdiction of English courts.
